Terms of Use & SMS Program Terms

These terms govern your use of www.yaritzabarroso.com (the “Site”) and your participation in the text messaging program operated by Yaritza Barroso, P.A., a licensed Florida real estate business affiliated with Lifestyle International Realty. By using the Site or opting in to text messages, you agree to these terms.

Part I — SMS Program Terms

1. Program description

Yaritza Barroso, P.A. operates a text messaging program for people who ask to be contacted about real estate services. If you opt in, we may send you text messages that include: replies to an inquiry you submitted; appointment, showing and open house coordination; property and listing information you asked for; market updates for the areas you are interested in; documents and next steps during a transaction; and follow-up about your buying or selling goals.

Messages are sent by Yaritza Barroso, P.A. Messages are conversational and account-related, sent by or on behalf of your real estate agent. This is not an automated bulk marketing list, and we do not send third-party advertising of any kind.

2. How you join, and that it is optional

You join the program only by affirmatively checking the unchecked consent box that appears next to the consent language on a form on this Site, or by giving us express written or verbal permission directly. Providing a phone number is optional on every form on this Site.

Consent to receive text messages is not a condition of purchase and is not required to submit any form, to receive a reply, or to buy or sell a home with us. If you do not check the box, we will not send you text messages.

You must be at least 18 years old and the account holder of, or authorized to use, the mobile number you provide.

3. Message frequency

Message frequency varies. Message volume depends on your activity and on where you are in a transaction. There is no fixed number of messages per month.

4. Cost

Message and data rates may apply. We do not charge you for the messages, but your mobile carrier may charge you for sending and receiving them under your plan. Check with your carrier if you are unsure of your rates.

5. How to opt out — STOP

You can cancel at any time. Reply STOP to any text message you receive from us. After you send STOP, we will send you one final message confirming that you have been unsubscribed, and after that you will receive no further text messages from us.

If you want to rejoin later, sign up again on the Site or ask us directly, and messages will resume.

6. How to get help — HELP

7. Carriers are not liable

Wireless carriers are not liable for delayed or undelivered messages. Delivery of text messages is subject to effective transmission by your wireless service provider and is outside our control. We do not guarantee that any message will be delivered, or delivered on time. Carriers are not responsible for the content of the messages.

8. Supported carriers and devices

The program is available on most major United States wireless carriers. Carrier participation can change without notice, and not all handsets or plans support all messaging features. We are not responsible for messages that cannot be delivered because of your device, plan or carrier.

9. Your privacy

Our handling of your mobile number and your consent is described in full in our Privacy Policy. In short: no mobile information will be shared with third parties or affiliates for marketing or promotional purposes, and text messaging originator opt-in data and consent will not be shared with any third parties.

10. Changes to the program

We may change or end the text messaging program at any time. If we make a material change to these SMS terms, we will post the updated terms on this page and update the date at the top. Continuing to participate after a change means you accept the updated terms.

Part II — Terms of Use for the Site

11. About the Site

The Site is operated by Yaritza Barroso, P.A. and presents information about real estate services in Miami-Dade and Broward County, Florida. Yaritza Barroso is a licensed Florida real estate agent; all real estate services are provided through Lifestyle International Realty. Each office is independently owned and operated.

12. Property information is not guaranteed

Listing and sold-property information on the Site is compiled from sources believed to be reliable, including the MLS and public records, but is not guaranteed and should be independently verified. Prices, availability, square footage, lot size, taxes, school assignments and features change and may be inaccurate or out of date. Nothing on the Site is an offer to sell or a solicitation of an offer to buy any property.

The Site is not intended to solicit properties already listed with another broker.

13. Home valuations are estimates

Any home valuation, comparative market analysis or price estimate we provide is an opinion of value prepared for your information. It is not an appraisal, was not prepared by a licensed appraiser, and may not be used for lending, tax, legal or insurance purposes. Actual sale price depends on market conditions, property condition and negotiation.

14. Not professional advice

Content on the Site is general information about real estate, not legal, tax, financial, mortgage, insurance or engineering advice. Consult a qualified professional in the relevant field before acting. No agency or fiduciary relationship is created by browsing the Site or submitting a form. A representation relationship begins only when a written brokerage agreement is signed.

15. Equal Housing Opportunity

We are committed to and comply with the federal Fair Housing Act, the Florida Fair Housing Act and the Equal Credit Opportunity Act. We do not discriminate on the basis of race, color, religion, sex, handicap, familial status, national origin, or any other protected class under applicable law.

16. Acceptable use

You agree not to use the Site to submit false information or another person’s contact details without their permission; to send automated, bulk or fraudulent form submissions; to scrape, copy or republish listing content or photographs; to attempt to gain unauthorized access to the Site or its systems; or to use the Site for any unlawful purpose.

17. Intellectual property

The design, text and original photography on the Site are owned by Yaritza Barroso, P.A. or used with permission and may not be reproduced without written consent. Listing photographs remain the property of their respective copyright holders. REALTOR® is a registered collective membership mark of the National Association of REALTORS®.

18. Third-party links

The Site links to third-party sites such as Zillow and the brokerage website. We do not control those sites and are not responsible for their content, accuracy or practices.

19. Disclaimer and limitation of liability

The Site is provided on an “as is” and “as available” basis, without warranties of any kind, express or implied, to the fullest extent permitted by Florida law. We do not warrant that the Site will be uninterrupted, error-free or secure.

To the fullest extent permitted by law, Yaritza Barroso, P.A. is not liable for any indirect, incidental, consequential or punitive damages arising from your use of the Site or reliance on its content. Nothing in these terms limits any liability that cannot be limited under Florida law, and nothing here limits the professional duties a licensed real estate agent owes a client under Chapter 475 of the Florida Statutes.

20. Governing law

These terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Miami-Dade County, Florida.
